These terms are between you and Kayode Fashola ("we", "us") and cover your use of the SoreTrace mobile application. By installing or using SoreTrace, you accept these terms. If you do not accept them, do not use the app.
This is the most important term in this document.
SoreTrace is a personal wellness journal. It records how sore you say you feel and offers general, non-prescriptive stretch suggestions. It does not diagnose, treat, cure, or prevent any condition, and it is not a medical device.
SoreTrace is not a substitute for advice from a physiotherapist, doctor, coach, or other qualified professional. Do not use it to decide whether an injury is serious. If you have sharp pain, pain that persists or worsens, swelling, numbness, reduced range of motion, or any symptom that concerns you, stop training and seek professional care.
You are solely responsible for what you do with the information in the app, including whether you train, rest, or stretch. Exercise and stretching carry inherent risk of injury. Only you can judge your own limits.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use SoreTrace on devices you own or control, for your own non-commercial use, in line with the App Store or Google Play terms that apply to your download.
You may not copy, modify, reverse engineer, decompile, resell, sublicense, or redistribute the app or any part of it, except where that restriction is prohibited by law.
SoreTrace stores your logs on your device only. We operate no server and hold no copy of your records. This means we cannot recover your logs if you delete the app, reset the device, lose it, or switch phones. Keeping your own copy of anything important is your responsibility. See the Privacy Policy for detail.
The core of SoreTrace is free. SoreTrace Pro is an optional auto-renewing subscription that unlocks full recovery history, personal recovery insights, and a choice of reminder timing.
Refunds are handled by the store you bought from, not by us. Request one through Apple (reportaproblem.apple.com) or Google Play. We have no ability to issue or reverse a charge.
Price changes will be notified to you in advance by the store, and you may cancel before they take effect.
We may add, change, or remove features, including moving a feature between the free and Pro tiers, or discontinuing the app. If we discontinue SoreTrace, any active subscription will be allowed to run to the end of its paid period or be refunded pro rata through the relevant store.
SoreTrace is provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the app will be uninterrupted, error free, or that reminders will always be delivered on time, since notification delivery is controlled by your device and its power-saving settings.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of your use of SoreTrace. Our total liability for any claim relating to the app is limited to the amount you paid us for it in the twelve months before the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Apple and Google are not parties to these terms and have no responsibility for SoreTrace. They are, however, third-party beneficiaries entitled to enforce these terms against you. Any claim about the app should be directed to us at support@soretrace.app, not to Apple or Google.
These terms apply until terminated. They end if you stop using and delete the app, or if we terminate them because you have breached them. Sections 2, 4, 7, 8, and 9 survive termination.
These terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. If you are a consumer, you keep the benefit of any mandatory consumer protections of the country you live in.
